Lunch and learn with Douwe Korff
May you train AI on your pseudonymised data? The EU is currently pulling in two directions at once, and the answer is changing. Douwe Korff explains what is at stake.
Why this matters
A model cannot be untrained
Most companies building or buying AI work on the assumption that pseudonymised data is free to use. The whole risk picture rests on that judgement, and it is being reconsidered right now.
The European Commission digital omnibus opens the door to using lightly pseudonymised data for training AI models. The new EDPB guidelines on anonymisation pull the other way. Two processes, running at the same time, giving different answers to the same question.
Meanwhile the decisions are being made. Training data is chosen, vendor contracts are signed, models go into production. What makes this different from most compliance questions is that these decisions cannot be reversed afterwards. A model trained on data you were not allowed to use cannot be untrained.
Douwe Korff has written a paper on what is actually changing and where he sees the risks. The session is his walkthrough of where the law stands in October 2026, and what it means for the people making those calls.
The EDPB consultation closes on 30 October, seven days after the session. Until then there is still time to respond.
The speaker
Douwe Korff
Douwe Korff is a Dutch lawyer and Emeritus Professor of International Law at London Metropolitan University. He has worked on data protection and human rights for more than thirty years, has carried out several studies for the European Commission on how the data protection directives were implemented, and has been heard as an expert by the European Parliament and the Council of Europe, among others.
He is not a neutral observer of the omnibus, and he says so. That is the point of inviting him.
What you get
A paper and the session
The paper. A ten-page analysis written by Douwe Korff and published by Lawgent, delivered as a PDF. The paper is not published openly until November, after the EDPB has processed the consultation. Until then it comes with your ticket. It is written to be forwarded to the people on your side who need to act on it.
The session. Thirty minutes of presentation and ten minutes of questions, directly with Korff.
Who it is for
Made for the people who own the question
